Expanding Geographical & Virtual Jurisprudence—The Extended Workplace

One of the most progressive features of the POSH Act, 2013 , is its dynamic definition of the "workplace." Unlike traditional labor statutes that restrict jurisdiction to physical factory floors or registered office suites, Section 2(o) introduces the doctrine of the Extended Workplace. This provision recognizes that modern professional interactions extend far beyond four physical walls and standard business hours. Under Indian jurisprudence , a workplace includes any place visited by an employee arising out of or during the course of employment, including transportation provided by the employer. Over the years, judicial precedents have expanded this definition to cover official offsites, client dinners, industry conferences, and work-related social gatherings. If the presence of the employees at a location is driven by their employment relationship, that location falls squarely under the IC's jurisdiction. In today's remote and hybrid work culture, the extended w...

Posh act 2013: Deconstructing Section 13(3)(i)

What "In Such Manner as May Be Prescribed" Actually Means One of the most litigated phrases within the POSH Act, 2013 is found in Section 13(3)(i), which directs employers to act upon the recommendations of the IC "in accordance with the provisions of the service rules applicable to the respondent." For years, defense counsels have aggressively interpreted this phrase as a statutory mandate to trigger a completely fresh, separate disciplinary inquiry from scratch under standard corporate service codes. The Bombay High Court’s analysis in the Arun A. Iyer judgment has provided a definitive clarification, cutting through this deliberate misinterpretation. The Division Bench clarified that the reference to service rules in Section 13(3)(i) refers strictly to the mechanism and scale of executing the penalty, not to the rebuilding of the inquiry process itself. In other words, the service rules are consulted to determine what constitutes a "major penalty" vers...

Madhya Pradesh High Court Clarifies Conciliation is Mandatory Under POSH Act Before Formal Inquiry

In a significant judgment reinforcing the principles of fairness and restorative justice under the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013 ( POSH Act ), the Madhya Pradesh High Court in the case of Dr. Kali Charan Sabat vs. Union of India & Others (W.P. No. 10021/2024) has held that conciliation under Section 10 of the Act is mandatory before an Internal Committee (IC) proceeds with a formal inquiry, provided the complainant is open to conciliation. The case arose when Dr. Kali Charan Sabat challenged the initiation of an inquiry by the Internal Committee without being given the opportunity for conciliation as envisaged under the POSH Act. The petitioner argued that Section 10 of the Act provides for a mechanism where, upon receipt of a complaint, the IC must offer conciliation to the aggrieved woman before resorting to a full-fledged inquiry. The failure to follow this mandatory step, according to the petitioner, was a violation o...

Who is the Inventor of POSH Law and Is It Good for the Corporate World?

In today’s corporate world, a safe, respectful, and inclusive workplace is not just a goal — it's a necessity. One of the most significant steps taken in India toward ensuring workplace dignity was the introduction of the POSH Law , formally known as The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. But who really invented this law, and is it effective in making the corporate world a better place? Let’s explore. Who is the Inventor of POSH Law? While no single person is credited as the "inventor" of the POSH Law, its roots trace back to a landmark judgment by the Supreme Court of India in the Vishaka vs. State of Rajasthan case in 1997. This judgment laid the foundation for what would later become formal legislation in 2013. The credit for initiating and shaping the POSH law goes to: Vishaka Group of NGOs: A collective of women's rights groups that filed the petition. Justice Verma Committee: Formed after the Nirbhaya cas...

How to Conduct an Effective Awareness Program on Sexual Harassment at the Workplace.

An effective awareness program on sexual harassment should begin with a clear definition of what constitutes harassment. Employees must understand not only the obvious forms of harassment, such as physical assault or verbal abuse, but also subtler behaviors like inappropriate comments, gestures, or advances. This comprehensive understanding can help prevent incidents before they occur. The program should be interactive and include real-life case studies that allow employees to identify and discuss potential harassment situations. Role-playing exercises can also help employees practice how to respond to harassment or report it appropriately. This will make them feel more confident in identifying problematic behaviors and taking action. Awareness programs should be conducted regularly and tailored to the specific needs of the workplace. For example, in industries with high turnover rates, it's important to offer refresher training to ensure all employees are up to date on the organi...

Posh in Higher Education Institutions in India

On July 25, 2022, an Odisha college student accused the school's physics instructor of rape and sexual harassment. The accused lecturer, who was the institution's reader, had also held the role of NCC officer in the Naval wing. Despite the female student coming to the institute with a formal complaint, the school's internal committee did not discover any proof of the claims she claimed. The probe didn't start until the Higher Education Department became aware of the situation. A Presidency University student from Kolkata filed a formal complaint with the internal committee of the university accusing Mahitosh Mandal, the former head of the department, of sexual harassment on July 17, 2022. In a progressive step towards ensuring a safe and secure work environment for all employees, the Delhi High Court delivered a landmark judgment in the case of Sethunath Singh v. Ministry of Home Affairs (2018). This ruling reinforced the principle that the Prevention of Sexual Harassment (POSH) Act extends its protection to all employees, irrespective of their employment status, be it permanent, temporary, or ad-hoc. The Genesis of the Case The case arose from a petition filed by Sethunath Singh, a former ad-hoc employee of the Ministry of Home Affairs (MHA). Singh alleged that he had been subjected to sexual harassment by a superior officer during his tenure. However, when he approached the Internal Complaints Committee (ICC) constituted by the MHA, his complaint was dismissed on the grounds that he was not a permanent employee and, therefore, not covered under the purview of the POSH Act. The Pivotal Ruling The Delhi High Court took cognizance of the matter and delivered a landmark ...

Posh at Workplace

POSHADVO has been founded to help keep workplaces free of sexual abuse across all sectors in the country. POSHADVO  firmly believes, as an organization, that  sexual harassment  is a serious denial of the right to equality, dignity and respect. Sexual abuse at work is something that most people routinely witness, but many do not openly speak about. Typically, this is for fear of losing their job, facing society's scorn, being caught up in never-ending court action or for other unspecified reasons. Posh @ Workplace Gender equality in all dimensions is a basic human right and the Constitution of India (“Constitution”) guarantees all its citizens equality of status and opportunity.  Sexual harassment  is considered as a violation of a woman’s fundamental right to equality, which right is guaranteed by Articles 14 and 15 of the Constitution. The Constitution also provides every citizen the ‘right to practice or carry out any occupation, trade or business, whi...
